Sampling Law?

I was wondering if anyone knew the law that surrounds sampling another artist...I remember hearing that if you change every 7th note then it would not be copyright infringement. Any idea?

There is no "law" so to speak. The precedent has been set previously in court by various lawsuits..along with copyright law in general. Essentially, no sample, even if it's a single stab is legal to use if it's from another copyrighted recording. Now whether or not anyone could actually recognize that single stab depends.

Go to copyright.gov for more info...also do a search for copyright law + court cases + sampling and variations on that. There's a lot of information out there.

You sound like Vanilla Ice when he was trying to explain his use of that Queen's song!

But if any notes or melodies sound similar to another artist work it could be grounds for copyright infringement. As long as you don't do their work note for note.

The seven not rule is a precedent that applies to original works not sampled work. So if you write an 8 note melody that is exactly the same as someone else's work you're libel for damages to the owner of the original work.

Strictly speaking, sampling with out permission is always illegal, but as someone previously stated the person you sampled has to know that it's happened to bring a suit against you.

You cannot sample e.g. take a piece of copyrighted music to include in your own work, unless previous settlement with the owner of the copyright.

Never heard of 7ths in sampling. That is related to the writing of the score..Anyway, [/thread]
