Myspace music legality?

Just a quick question of opinion and/or legality.

If an artist has a question on their myspace available from download, is that legal to use?

As far as I see it, they are giving it out, therefore it should be fine...is that correct?

But say I took the music from another persons MySpace and made it available to download on mine, would that make it legal?

im pretty sure it's ok... although trying to get popular through myspace is a sure-fire way to not be taken seriously.

to dj with it yes it's perfectly legal, if they are offering it you for free then the chances of a record label having any control over that material is next to nothing. also they probably want you to do that (dl and play to mates) it's a perfect and very cheap way of getting a promo out.

lol at Dj Duz, that's a fair point...theres also another one i think which blew up from myspace, um some song i hate...um ah sandie thom..

anyway, yeah i would assume that by making it available to download, that would be them giving it to people for free.

the main reaosn i ask is, a couple of local djs have a myspace site up with some bootlegs and mixes available to download, a couple which are quite good, and i wouldnt mind using them in a mix sometime

That would probably not be legal. The copyright owners of the songs still own the copyright whether or not a dj decides to make a mix and let people download it for free. Ripping tracks out of a mix you downloaded for free does not mean that the original artists have agreed to allow you to use their music.

yeah good point...hmmm...
but like the other poster said, if it was a track that somebody made eg not a remix of another song but something they did on acid or ableton, and they put it on their myspace to download, it would be the same as buying the track off beatport etc

Almost all music that is downloadable is for personal use only.
(ya cant rebroadcast it/play it to the public/sample it for free)
They still own the copyright on it.

Chances of getting caught using it are slim though.
