If you upload music on, say myspace.

and its something that is remixed is it legal to put up?

i heard its not but if its remixed than maybe its different?

just want to know the legalities of this and the likely hood the artist would take it down if they ever heard it

Very very grey area. Too broad to explain. Basically, keep this rule in mind: If the music isn't your or it isn't properly licensed, you can get in trouble.

If you're not selling it then the most they'll do really is ask you to take it down. If you fail to, then they may take you to court. You'll be fine pretty much if you put it up basically but be sure to give credit where it's due etc at the very least.

Although, I hear plenty of tracks on Myspace pages from artists and I have yet to hear of any legal action, but I didn't just type this, so you can't quote me on it.

It's not legal... but sometimes there are creative commons whatever the fu*k type things that make it ok. The chances of being caught are slim though. Most websites fail and never get much traffic.

personally if i was an artist i would be stoked to see some random kid tweekin my shit

its kinda like the only way to get your stuff on the web too so you gotta take that outlet.

You can make a Dj mix available, but you are not allowed to sell it. As long as you don't sell it, it can be considered as a free advertising of the copyrighted material that is involved.

You have to own the mechanical rights which you don't.

Publishing companies.

These deal with songwriters, artists and performers, and are being responsible for giving them royalties in return for the handling of their copyrighted material. A music publisher is expected to handle the song registration, its licensing, and the collection of royalties. To fulfill the registration process, the publisher should contact the ASCAP, the BMI or the PRS to inform them about the new material and gives them any information that can seem relevant.

The American Society of composers, Authors and Publishers (www.ASCAP.com)
Broadcast Music Incorporated (www.BMI.com)
These are the two American performing rights societies.

The Performing Rights Society (www.PRS.co.uk), being the English equivalent, monitor any registered media, public places and establishments, collect royalties in exchange of the right for public broadcast, and reassign these royalties to their rightful owners, the artist or songwriter but also the music publisher. The Performing rights society will usually split equal shares of the money collected. When assuming that the songwriter has a share of fifty percent, the publisher should also give back the correct percentage of his own share as the songwriter is due a percentage of the label’s benefits as specified by the record contract.

The artist is also entitled to what is called “mechanical rights”, which include the right to copy and sell the material. In America, mechanical royalties will be paid to the publisher from the record company. Following this, the label will issue a payment to the artist according to the number of copies sold, and details agreed in the record contract.

In the United Kingdom, the performing rights society is associated with the Mechanical Rights Protection Society, (www. MCPS.com) . Here, the record label does not pay the music publisher, but instead, it pays the MCPS a percentage based on sales figures of a copyrighted material. As soon as this material is registered within the MCPS, the collection of mechanical royalties can be initiated.

Why sell DJ mixes? There's a buttload of DJs out there with mixes online for download.

Better just to have them online for download and let people enjoy your mad skills.
